Departments Update Gag Clause Prohibition Attestation Submissions for 2024
On Friday, May 24, 2024, the Centers for Medicare & Medicaid Services posted updates to the Instructions, User Manual, and Template for the 2024 Gag Clause Prohibition Compliance Attestation. The communication, issued by the Departments of Labor, Treasury, and Health and Human Services (Departments), notes that the Gag Clause Prohibition Compliance Attestation system features have been refreshed. The new features include modifications to the Webform and Template to include additional information to be provided by attesters, as well as revised guidance via Instructions and User Manual. Group health plans and insurers must submit the 2024 attestation using the updated system by December 31, 2024.
