HHS Issues New Report on HealthCare.gov Enrollment by Race and Ethnicity
On October 25, 2022, the Department of Health and Human Services (HHS) issued a new report entitled HealthCare.gov Enrollment by Race and Ethnicity, 2015–2022. The report includes statistics on enrollment in the Affordable Care Act marketplace in populations with historically high uninsured rates. According to the report, there were significant gains in health insurance coverage during the 2021 and 2022 HealthCare.gov open enrollment periods among such populations.

PBGC Posts 2023 Maximum Monthly Guarantee Limits
On October 19, 2022, the Pension Benefit Guaranty Corporation (PBGC) posted a table showing the 2023 guarantee limits for various ages and payment forms. As a result of the indexing rules provided by law, the maximum guarantee limits for single-employer plans that fail in 2023 will be 8.79% higher than the limits that applied for 2022. The guarantee limits for multiemployer plans are not indexed and have not changed.

EEOC Announces Release of Updated “Know Your Rights” Poster
On October 19, 2022, the Equal Employment Opportunity Commission (EEOC) released the “Know Your Rights: Workplace Discrimination is Illegal” poster, which updates and replaces the previous “EEO is the Law” poster. Covered employers are required by federal law to prominently display the poster at their work sites. The poster also includes a QR code for applicants or employees to link directly to instructions for how to file a charge of workplace discrimination with the EEOC.

The new “Know Your Rights: Workplace Discrimination is Illegal” poster includes these changes:

  • Notes that harassment is a prohibited form of discrimination;
  • Clarifies that sex discrimination includes discrimination based on pregnancy and related conditions, sexual orientation, or gender identity;
  • Adds a QR code for fast digital access to the how to file a charge webpage; and
  • Provides information about equal pay discrimination for federal contractors.

IRS Issues 2023 Benefit Contribution Limits
On October 18, 2022, the Internal Revenue Service (IRS) issued Revenue Procedure 2022-38, updating the indexed contribution limits for certain employee benefit programs.
